These Terms of Service ("Terms") govern your access to and use of AgentLaunchPad OS, ALP5 CRM, associated websites, applications, software, AI systems, automation tools, APIs, integrations, messaging systems, and related services (collectively, the "Platform"). By accessing, creating an account, subscribing to, or using the Platform, you agree to be bound by these Terms. If you do not agree, you may not access or use the Platform.
1. About AgentLaunchPad OS
AgentLaunchPad OS ("AgentLaunchPad OS," "ALP5 CRM," "Company," "we," "our," or "us") is an independent software platform designed to help real estate professionals organize contacts, track activities, manage pipelines, monitor goals, improve operational consistency, and support business productivity.
The Platform may include: CRM functionality, follow-up systems, lead management tools, goal tracking, AI-assisted recommendations, communication tools, email and SMS tools, automation systems, reporting tools, educational resources, and integrations with third-party providers.
AgentLaunchPad OS is not a real estate brokerage, lender, title company, compliance company, legal service, tax advisor, financial advisor, supervisory brokerage authority, MLS provider, or Fair Housing compliance provider. The Platform is provided solely as a software and operational organization system.
2. Eligibility
To use the Platform, you must be at least 18 years old, have authority to enter legally binding agreements, use the Platform in compliance with all applicable laws, and not be prohibited from using the Platform under applicable law.
3. Account Registration
You agree to provide accurate information, maintain current account details, maintain the confidentiality of login credentials, notify us immediately of unauthorized access, and accept responsibility for all activity under your account. You are solely responsible for maintaining the security of your account.
4. Subscription Services
Certain portions of the Platform require paid subscriptions. Subscription terms, pricing, billing frequency, and feature access may vary by plan. All subscriptions are governed by our Subscription & Billing Policy below.
5. Free Trial Offers
We may offer promotional free trials. Unless otherwise stated, free trials automatically convert into paid subscriptions at the end of the trial period. Billing begins immediately following the trial period. Users are responsible for canceling before renewal if they do not wish to continue. We reserve the right to modify or discontinue trial offers at any time.
6. Acceptable Use
You agree to use the Platform lawfully and responsibly. You may not:
Violate any federal, state, or local laws, including Fair Housing, MLS rules, TCPA, Do Not Call, or CAN-SPAM
Send unlawful spam or solicitations
Upload malicious code or attempt unauthorized access
Reverse engineer the Platform or scrape data without authorization
Interfere with Platform operations or use it for fraudulent purposes
Impersonate others or circumvent security protections
We reserve the right to suspend or terminate accounts violating these Terms.
7. Communications & Marketing Compliance
Users are solely responsible for all calls, text messages, emails, marketing campaigns, lead outreach, and client communications. You agree to comply with TCPA, CAN-SPAM, Arizona marketing laws, Do Not Call regulations, A2P 10DLC requirements, Fair Housing laws, MLS regulations, real estate advertising rules, and Arizona Department of Real Estate regulations.
AgentLaunchPad OS may provide tools to assist with compliance (opt-out functionality, consent tracking, messaging controls) but does not guarantee legal compliance. Users remain solely responsible for ensuring lawful communications.
8. A2P 10DLC & Text Messaging Compliance
If text messaging functionality is offered through the Platform, users must obtain appropriate consent before sending messages, comply with carrier requirements, include lawful opt-out instructions where required, and may not use purchased lists or unlawful messaging campaigns. Failure to comply may result in message restrictions, carrier blocking, suspension, termination, or legal reporting.
9. User Responsibilities
Users are solely responsible for client communications, brokerage compliance, recordkeeping obligations, data accuracy, marketing compliance, regulatory compliance, contact management, uploaded content, real estate disclosures, Fair Housing compliance, and MLS compliance. The Platform is only a software tool and not a compliance system.
10. Sensitive Information Restrictions
Users agree not to upload or store Social Security numbers, credit card numbers, bank account credentials, medical records, protected health information, highly sensitive financial information, government-issued identification numbers, biometric information, or highly confidential personal information unnecessary for CRM operations. Users assume all responsibility for uploaded information.
11. Data Ownership & Platform Rights
Users retain ownership of content uploaded into the Platform. However, users grant AgentLaunchPad OS a limited license to host, store, process, display, transmit, back up, secure, and analyze such content as necessary to operate the Platform. AgentLaunchPad OS does not sell customer CRM data.
12. Data Processor Status
AgentLaunchPad OS acts primarily as a software provider and data processor on behalf of users. Users remain the data controllers responsible for lawful collection of data, obtaining necessary consent, compliance with privacy laws, and accuracy of stored information.
13. AI Features & Automation Disclaimer
The Platform may include AI-generated recommendations, workflows, automation systems, task suggestions, messaging suggestions, reporting tools, or predictive systems. AI outputs may contain inaccuracies, are informational only, and do not constitute legal, financial, compliance, brokerage, or business advice. Users remain solely responsible for reviewing all generated content before use. AgentLaunchPad OS makes no guarantees regarding AI accuracy, lead quality, marketing effectiveness, regulatory compliance, or business outcomes.
14. Intellectual Property
All Platform content, branding, workflows, software, interfaces, visual systems, AI systems, automation structures, graphics, code, and functionality are owned by or licensed to AgentLaunchPad OS. Users may not copy, resell, reproduce, distribute, reverse engineer, license, exploit, or modify any portion of the Platform without written permission.
15. Beta Features
Certain Platform features may be designated as beta, experimental, or early-access. Beta features are provided "AS IS" without warranties of any kind. We may modify or discontinue beta features at any time.
16. Third-Party Services
The Platform may integrate with third-party providers including Stripe, Firebase, Netlify, Google, GoDaddy, SMS providers, email providers, analytics providers, and AI providers. We are not responsible for third-party outages, data loss, security failures, carrier restrictions, or payment processor interruptions. Third-party services are governed by their own terms and policies.
17. Platform Availability
We do not guarantee uninterrupted access. The Platform may experience downtime, bugs, delays, maintenance, security events, connectivity interruptions, or third-party outages. We reserve the right to modify, suspend, or discontinue portions of the Platform at any time.
18. Data Export & Account Deletion
Users are responsible for exporting desired data before account termination. Following termination or extended inactivity, data may become inaccessible or permanently deleted. We reserve the right to delete inactive accounts and associated data after extended inactivity.
19. No Guarantees or Earnings Claims
AgentLaunchPad OS does not guarantee income, commissions, leads, closings, productivity improvements, business growth, or financial success. Results depend on user effort, market conditions, brokerage support, business practices, and external factors.
20. Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, AGENTLAUNCHPAD CRM DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, SECURITY, AND AVAILABILITY. We do not guarantee uninterrupted or error-free operation.
21. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, AGENTLAUNCHPAD CRM SHALL NOT BE LIABLE FOR lost profits, lost commissions, lost data, business interruption, marketing violations, regulatory penalties, brokerage disputes, MLS violations, TCPA violations, Fair Housing claims, third-party outages, indirect damages, or consequential damages. In no event shall our total liability exceed the total subscription fees paid by the user during the prior three (3) months.
22. Indemnification
Users agree to defend, indemnify, and hold harmless AgentLaunchPad OS and its owners, affiliates, employees, contractors, licensors, successors, and assigns from any claims arising out of user conduct, user communications, marketing activities, violations of law, brokerage violations, MLS violations, Fair Housing violations, TCPA violations, uploaded content, use of AI-generated outputs, or misuse of the Platform.
23. Force Majeure
AgentLaunchPad OS shall not be liable for delays or failures caused by events beyond reasonable control including internet outages, government actions, natural disasters, carrier failures, cyberattacks, labor disputes, third-party outages, or power failures.
24. Arbitration & Class Action Waiver
Any disputes arising from these Terms or the Platform shall first be attempted to be resolved informally. If unresolved, disputes shall be resolved through binding arbitration in Maricopa County, Arizona. Users waive participation in class actions, collective actions, and representative actions to the fullest extent permitted by law.
25. Governing Law
These Terms shall be governed by the laws of the State of Arizona.
26. Changes to Terms
We may update these Terms periodically. Continued use of the Platform after updates constitutes acceptance of revised Terms.
This Subscription & Billing Policy explains how subscriptions, billing, payments, renewals, cancellations, and promotional pricing work for AgentLaunchPad OS.
1. Subscription Overview
AgentLaunchPad OS is offered as a subscription-based software platform. Subscriptions may include monthly plans, promotional pricing, ALP5 member pricing, add-on services, beta access, and trial subscriptions.
2. Billing Cycles
Subscriptions are billed in advance on a recurring basis. Billing schedules may include monthly billing, promotional billing schedules, trial conversions, and add-on charges. Applicable billing schedules are presented during checkout.
3. Free Trials
AgentLaunchPad OS may offer promotional free trials. Unless otherwise stated, free trials automatically convert into paid subscriptions and billing begins immediately after the trial period ends. Users must cancel before renewal to avoid charges. Free trials may be limited per user, account, payment method, or business. We reserve the right to modify or discontinue free trials.
4. Automatic Renewal
Subscriptions automatically renew unless canceled before the next billing cycle. By subscribing, users authorize recurring charges through Stripe or applicable payment processors.
5. Subscription Pricing
Pricing may vary based on promotional offers, ALP5 pricing, launch pricing, feature tiers, add-on services, and beta programs. Displayed checkout pricing controls the applicable rate.
6. ALP5 Member Pricing
Eligible AgentLaunchPad5 members may receive discounted pricing. Discount eligibility may be promotional, time-limited, require verification, and may change over time. We reserve the right to modify or discontinue discounts.
7. Payment Processing
Payments are securely processed through Stripe or other approved processors. We do not directly store full payment card information. Users authorize AgentLaunchPad OS and payment processors to charge the selected payment method.
8. Failed Payments
If payment fails, we may retry payment methods, restrict access, suspend premium features, downgrade functionality, or terminate subscriptions. Users are responsible for maintaining valid payment information.
9. Cancellation Policy
Users may cancel subscriptions at any time. Cancellation stops future billing but does not retroactively refund prior charges or provide prorated refunds unless required by law. Access continues through the active billing period. Users are responsible for canceling before renewal.
10. Refund Policy
Unless otherwise required by law, subscription fees are non-refundable. Partial billing periods, promotional plans, and unused subscription time are non-refundable. Exceptions may be granted solely at our discretion.
11. Chargebacks & Payment Disputes
Users agree to contact AgentLaunchPad OS before initiating chargebacks whenever possible. Fraudulent or abusive chargebacks may result in suspension, termination, loss of promotional pricing, or restriction from future services.
12. Taxes
Applicable taxes may be added where required by law. Users are responsible for sales taxes, VAT, local taxes, and regulatory fees.
13. Subscription Changes
We reserve the right to modify pricing, add pricing tiers, change feature access, discontinue plans, or introduce new offerings. Reasonable notice may be provided before pricing changes take effect.
14. Suspension & Termination
We reserve the right to suspend or terminate accounts for nonpayment, fraudulent activity, violations of Terms, chargebacks, abuse of the Platform, illegal conduct, or security concerns. Termination does not eliminate outstanding payment obligations.
15. No Guarantee of Results
Subscription access does not guarantee leads, income, closings, productivity improvements, or business growth. Results depend on user effort and external factors.
16. Changes to Policy
We may update this Policy periodically. Continued use after updates constitutes acceptance of revised terms.

3. How We Use Information
We may use information to operate the Platform, authenticate users, process subscriptions, provide support, improve functionality, monitor security, prevent fraud, analyze usage, develop features, send service announcements, and enforce agreements. We do not sell customer CRM data.
4. Data Processor Status
AgentLaunchPad OS primarily acts as a data processor on behalf of users. Users remain responsible for obtaining consent, lawful data collection, privacy law compliance, and accuracy of uploaded data.
5. Third-Party Providers
We may rely on Stripe, Firebase, Netlify, GoDaddy, analytics providers, email providers, SMS providers, and AI providers. Third-party providers may process information as necessary to provide services.
6. Data Security
We implement commercially reasonable safeguards including SSL/HTTPS encryption, authentication protections, access controls, secure cloud infrastructure, and database security rules. However, no electronic system is completely secure.
7. Arizona Data Breach Compliance
In the event of a qualifying data breach involving personal information, AgentLaunchPad OS will comply with applicable Arizona data breach notification laws, including A.R.S. § 18-552. Where required, we may notify affected users, regulatory authorities, and consumer reporting agencies within legally required timeframes.
8. Communications & Marketing Compliance
Users are responsible for ensuring compliance with TCPA, CAN-SPAM, Do Not Call laws, Arizona marketing laws, A2P 10DLC rules, and real estate advertising laws. The Platform may provide tools to support compliance but does not guarantee legal compliance.
9. Real Estate Compliance Responsibility
Users remain solely responsible for ADRE compliance, brokerage compliance, MLS compliance, Fair Housing compliance, and recordkeeping requirements.
10. Data Retention
We may retain data while accounts remain active, to comply with legal obligations, for backups and security, to resolve disputes, and to enforce agreements. We reserve the right to delete inactive accounts and data after extended inactivity.
11. Your Privacy Rights
Depending on applicable laws, users may have rights to access personal information, correct inaccurate information, request deletion, request export of data, and withdraw consent where applicable. Requests may be submitted to support@agentlaunchpadcrm.com. We may verify identity before processing requests.
12. California & State Privacy Rights
Residents of California and certain other jurisdictions may have additional rights under applicable privacy laws including CCPA, CPRA, CPA, CTDPA, UCPA, and VCDPA. We do not sell personal information as defined under these laws.
13. Children's Privacy
The Platform is intended only for users age 18 or older. We do not knowingly collect information from children.
14. AI Systems & Automated Processing
The Platform may use AI-assisted systems and automation. AI-generated outputs may contain inaccuracies, should be independently reviewed, and do not constitute legal or professional advice.
15. International Users
The Platform is operated primarily within the United States. Users accessing the Platform from outside the United States acknowledge that information may be processed in the United States.
16. Limitation of Liability
To the fullest extent permitted by law, AgentLaunchPad OS shall not be liable for data loss, security breaches beyond reasonable control, third-party failures, marketing violations, regulatory penalties, indirect damages, or consequential damages.
17. Changes to Privacy Policy
We may update this Privacy Policy periodically. Continued use of the Platform after updates constitutes acceptance of revised policies.
18. Governing Law
This Privacy Policy shall be governed by the laws of the State of Arizona.
